Koci lodged the plea on behalf of his client, arguing among others about Mazel´s Jewish origin.
Mazel told CTK he will lodge a legal complaint against Koci´s statement about his high prices today.
Koci represented Lucie Slegrova, a member of the far-right Workers´s Party of Social Justice (DSSS). She complained through him about Mazel´s bias.
Mazel said Slegrova´s statements at an extremists´ rally in Litvinov, north Bohemia, amounted to the propagation of Nazism and anti-Semitism.
Koci justified the complaint by Maze´s alleged financial dependence on the police, his activities in the government TOP 09 party and his Jewish origin.
Koci said today "the client´s justified interests take precedence over the lawyer´s own interests as well as over regard for other lawyers and other persons."
He said he never claimed that people of Jewish origin cannot hold the position of an expert. However, they cannot probably be impartial in assessing rightist extremism.
Koci and Slegrova derived Mazel´s origin from his surname that they claim derives from the Hebrew Moshe.
Koci said they never claimed that Mazel is a Jew, however, they only asked the court to check it.
The court is to make a decision on the bias plea by the end of the week.
"The more substantial part of the plea, however, rested in the opinion that the expert was economically dependent on one sole awarder, the Czech police, and that the expert´s remuneration that he was receiving from the state treasury can be considered high and overpriced," Koci said.
Koci said the effort to avoid further search for the level of Mazel´s remuneration may be behind his recent resignation as a sworn expert.
"These are mean lies, legal steps will follow immediately," Mazel reacted.
He said the expert opinion that Koci presented to journalists was drafted by more people. He himself really charged money for 690 hours that he spent on the opinion. He analysed CDs and material for the Power action that the police wanted to be prepared quickly, Mazel said.
He said he spent 70 days on it, and that he worked ten and even more hours a day. He said he was paid 300,000 crowns according to the relevant decree.
"The lawyer knows it, I have already answered his question," Mazel said.
Mazel helped prove the guilt of the arsonists from Vitkov, north Moravia, who in 2009 threw Molotov cocktails into a house inhabited by a Romany family. A girl, then two years old, suffered severe burns to 80 percent of her body.
She survived only thanks to doctors´ care, but her health has been permanently impaired.
Besides doing expert opinions, Mazel also works as a lawyer.
He said he has resigned as a sworn expert also because he could not deal with disputes with extremists on a personal level.
He confirmed the main reason for his resignation are continuous attacks by rightist radicals.
Mazel said the DSSS has also started to attack another sworn expert, Ivo Svoboda, on its web page.
Koci´s bias plea has stirred up public opinion. The board of the Czech Bar Association (CAK) will deal with his step next week.
The CAK control council will also deal with the case in reaction to lawyers´ complaints and it will decide whether to start disciplinary proceedings against Koci.
Constitutional Court chairman Pavel Rychetsky has also sharply spoken about Koci in the media.
