Czech Supreme Court upholds sentences for attack on Romanies

Brno - The Czech Supreme Court (NS) has refused the appellate reviews by the four arsonists sentenced to 20 to 22 years for an attack on a house in Vitkov, north Moravia, in which a then two-year-old girl suffered serious burns, NS spokesman Petr Knoetig told CTK today without elaborating.

Two perpetrators, David Vaculik and Jaromir Lukes, were given 22-year prison sentences by courts in Ostrava and Olomouc, both north Moravia, Vaclav Cojocaru and Ivo Mueller were sentenced to 20 years.

All of them were sentenced for an attempted multiple racially motivated murder and damaging other´s property.

According to the indictment, the four men attacked the house inhabited by a large Romany family in the night of April 19, 2009, throwing Molotov cocktails in the windows.

Three people received injuries. The girl, Natalka, suffered burns to 80 percent of her body, lost three hand fingers and her health has been permanently afflicted. She survived thanks to top-level medical care.

The High Court in Olomouc said in appeals proceedings in March the exceptional sentences imposed are strict, but not inappropriate.

"There is a high degree of social dangerousness. The most serious is the motive of the crime - the damaged persons´ being members of an ethnic minority. It is necessary to send out a clear signal that any criminal activities motivated by the attacked persons´ being different [from the majority population] will be strictly punished," Olomouc panel chairman Milan Kaderka said then.

The four extremists wanted the legal qualification of their act to be changed from murder to general threat in their appeals proceedings at lower-degree courts.

They claimed they did not not know that the house is inhabited, did not want to commit murder and that the intention to murder has not been proved.

Courts eventually concluded that the four men committed an attempted murder with an indirect intention.

The attackers had three bottles with a strongly inflammable substance and they established three fire hotbeds. Courts said it clearly shows that they knew that the house inhabitants may die. Author: CTK
